In 2008, a
66-year-old woman, Maria Garcia, died of a brain injury caused by the lack of
oxygen during a surgery. As a result, her family filed a malpractice suit
against the anesthesiologist.
The family was awarded $1.2 million after the jury deliberated for two weeks. The jury found the doctor professionally negligent. Additionally, they found that the cause of death was the doctor's negligence. The doctor failed to realize the breathing tube had moved and also failed to treat her very low blood pressure during the procedure.
