While over 2,000 Kugel Mesh victim have made settlements from C.R. Bard, the current parent firm of Davol, individuals are still filing lawsuits alleging the medical equipment manufacturer failed to make an effective design on hernia patches and failed to inform medical practitioners of known issues with the mesh.
The product liability litigation recently filed in the Rhode Island District Court produced a $184 million settlement dating all the way back to 2005, when Bard initiated a recall the firm’s products. The settlement came after a few of the 3,600-plus hernia lawsuits made its way to trial.
A few years ago, Christopher Torpe was given $1.5 million in damages as a result of sepsis infection and other internal injuries after the mesh patch broke inside his body. Along with the sepsis infection, victims claim to numerous complication which include bowel perforation, abscess formation, and intestinal fistulas.
Another class action settlement has been reached last year in Toronto. Attorneys in Canada and the United States are still probing claims.
