Raanan Katz has an unflattering photo of himself which he holds the copyright to. Irina Chevaldina used his photo as part of her blog in which she criticizes Katz and the management of the Miami Heat. Katz filed suit against Chevaldina alleging that she was violating copyright laws by using his photo on her personal blog. She argued fair use. There may be some confusion as to what constitutes fair use in this situation. Chevaldina does not profit from her blog, although there are some ads present on it which appear to benefit the hosting service rather than Chevaldina. Since she is not using the photo for monetary gain, it is unlikely that Katz will be able to win this case on the copyright claim. Since the work in question is a photograph, it is not likely that there will be any findings for or against the fair use argument.
