Coca-Cola along with its subsidiary, Minute Maid, thought they were exempt from a lawsuit since they are in compliance with requirements set forth by the Federal Food, Drug and Cosmetic Act. Coca-Cola's competitor, Pom Wonderful is pursuing a claim in which it states that the label of the Coca-Cola product "Pomegranate Blueberry Flavored Blend of Five Juices is misleading. The product only contains 0.3 percent pomegranate juice and just 0.2 percent blueberry juice. The primary ingredients are actually grape and apple juices. The suit states that the label is misleading since the term "pomegranate blueberry" is in capital letters and the phrase "flavored blend of 5 juices" uses a much smaller font. Kathleen Sullivan, the lawyer for Coca-Cola argued that the name of the product as well as the label have met the requirements set forth by the Food and Drug Administration. She further states that the Coca-Cola company does not assume that consumers are as unintelligent as "Pom must think they are." The Supreme Court has said that the suit can be pursued.
