WebMD Health Corp, one of the leading sources for health information made an announcement recently that its subsidiary, WebMD LLC, resumed with litigation against Everyday Health Media LLC, on trademark infringement, unfair competition, and making false advertisements.
The complaint from WebMD shows that Everyday Health is utilizing WebMD’s trademark on Everyday Health’s website pages, website addresses, and in search ad campaigns to trick and misinform consumers into believing they’re actually visiting one of WebMD’s trusted wellness and health resources.
WebMD believes that such practices also falsely leads advertisers, who have placed by Everyday Health on certain locations of its site that infringe trademarks by WebMD and going beyond the legal practice of buying search terms against the rival’s name.
WebMD is certain that Everyday Health’s actions constitutes trademark infringement, unfair competition, and false advertising based on the New York State law and Lanham Act, as well as misrepresentation and unjust enrichment, also under the New York State law.
